    For what its worth (I like that phrase/wording) I think "open meetings" is "optional" in Title 10. Bill or someone else may want to correct me if I'm wrong....if I am correct think about it.

    I agree we should work to elect a different minded board while the lawsuit works it's way through the courts.

    But it may not be completely out of the realm of possibility that the court rules the RCSC fits the definition of a planned community. There may be relevant precedent. As I understand it, Sun City Anthem was organized by Del Web similar to SC... ie, separate HOA and rec center (Anthem Community Council?). In 2011 the AZ Court of Appeals ruled that they did fall under 33 based on a member filed lawsuit and subsequent appeal. I don't know how "apples to apples" it is, but food for thought.

    Good to know a similarly goverened SC community has gone through this ahead of our SC. Interesting to note how hard the ACC is fighting it. Even if SC residents are satisfied with the way things have run in the past, I still see it as a good step for future protections. As Bill has brought up in earlier posts, we don't really know the future as far as who will manage SC. If volunteerism slacks off we may need to hire out as other communities have done. It would be good to have Title 33 safeguards already in place. Just changing the covenants so they reflect the Title 33 open meetings is a start but as we have seen..they can be rewritten on the whim of one board. They already have been. That's an uncomfortable and somewhat dangerous policy. Which is the reason Title 33 began in the first place.

    Thanks for posting that link IC; i had passed reading it when it was linked to the SC suit and now i see some similarities. That said, there are differences as well.

    It should be noted in the article the Anthem board argued they had been
    trying to move towards a more Title 33 like run community. I feel the same way, it would be better to do it that way than have it sh oved down our throat or up our butts.

    Sun City West has a very good website. There is so much information and interaction with their residents. I regularly read the Blog and the Weekly GM Reports. It does seem that they have more transparency which is not a bad thing. It seems to me that they do have to have more votes to approve changes, spending requests etc. which is so foreign to us in Sun City.
