Sorry, you can’t tell when and to whom I can respond. That statement was for everybody who has the right wing view, Heritage Foundation, Hillsdale college view of history. Wrong my friend! No law can supersede the Constitution and that's why people still own guns and we still have a 2nd Amendment! Besides, the reason we have the second amendment is because the Founders understood how governments often became heavy-handed. And after living under King George's laws, many people were very hesitant to institute a new form of government. The Founders wanted to make sure that We the People had a way to fight back, if necessary, to overturn a tyrannical government. Read Tocquelville's Democracy in America an see why American democracy was so much different from Europe and the old ways of Monarchs and Kings and why America became so great in such a short amount of time. Or read Vattels, Law of Nations. A document used by the Founders that established International laws. In fact, you can find reference to the Law of Nations in Article I, Section 8. Actually the Founders did not like standing armies as a result of pre Revolutionary War British occupation of the colonies, think Boston. The Second Amendment is closely tied with the Third regarding the quartering of soldiers in private residences, again think Boston. In that instance England sent so many troops there was lack of space in the barracks for them. Article I, Section 8 states that armies only exist for two years as appropriated. You will also note that the Founders had no problem with a navy as it really was the 400 Lb gorilla of the time. By the way, the Declaration of Independence is not part of our jurisprudence. I will concede that Jefferson talked about a revolution every 20 years or so, he was talking about voting and changing representation to prevent fossils like Mitch McConnell hanging on forever. Jefferson had seen enough bloodshed in his life that he would not be asking for more. I have not heard of the book Law of Nations and found no direct reference to it in your citation. While I might concede that the Founders might have read this book as they probably did Wealth of Nations, the Founders did incorporate historical law into our system of jurisprudence, i.e., Roman law (Justinian), English Common Law so therefore references to International Law were the accepted practices of the time. Some, while contained in the Constitution, are no longer practiced. An example is Article I, Clause 11. While I agree with the premise In Democracy in America, any real use for the monarchy died as a result of The Great War. Read The Guns of August by Barbara Tuchtmann. She is very readable and this book portents the slaughter of the War. I read this morning the Constitution, as Mom used to say “for the umpteenth time,” and found no reference to god let alone four times.
