Make your argument why you believe Title 33 would be better than Title 10! I tend to believe the problem isn't in the Title, the problem is in who we elect to the board. Sun City West, a Title 33 community, has had their own problems with board members.
John, On the surface, 33 seems appealing, but the pitfalls are not pretty. I don’t want that type of intrusiveness in my day to day life. And with the litigious society of today, it would mean more suits leading to higher insurance rates, leading to higher assessments. Sorry but Title 33 as a rule, just isn’t palatable to me.
I gave some additional thought to the Title 33 issue and went and did more reading in the Arizona Revised Statutes. Not sure if anyone else wants to slog through the section dedicated to managed communities or not, but it leaves a lot to be desired, in my opinion. First, it would require the rewriting of the corporate documents and lord knows what that would entail. The final outcome could be even scarier than what we have now. The ability for the state to regulate how the residents live and conduct themselves is not something I want legislated. How soon one can place outdoor decorations may seem trivial, but how many people might be reported because they keep twinkle lights on their houses year round. Or placing of flags. That could include those little flags people put up year round offering a hello or a seasonal welcome. With the condition of some of the property in Sun City, how would you litigate the home grown redone exteriors which would not pass code today? How would the grandfather clause work in the case of some of these places? Too much to ask for everyone to bring properties to code, they can’t afford it. So staying with what is in place is much better than trying to make the community meet unrealistic standards. IMHO
