Final board meeting of 2022 Puzzling Agenda

    Good questions eyes!

    That's the first question I asked myself too when I first read the agenda! What the heck are they Rescinding?

    If they're trying to pull the same stunt that they tried at the last meeting, which was to Rescind the motion that caused the "NO" vote when they tried to approve the 2023 proposed budget...NOPE...NO CAN DO! You can't rescind a motion that failed because there's nothing to rescind! (RONR 35:2 & 6:27 [4] )

    And what's the story with Director Lenefsky's motion?
    New Business 1. Secretary Lenefsky – I move to amend the 2023 budget to include $70,000 to conduct a Capital Reserve Study

    How do you amend a motion when there's no motion on the floor? Seems to me that there first needs to be a motion made to accept the 2023 budget before you can amend it!?!? Oh wait...that's probably where the motion to Rescind comes into play! Stupid me!

    I imagine some members of the Board read this blog, but I doubt it has any effect. All I can say is if they are, in fact, trying to rescind the motion so they can vote on the budget again, then they might as well tell the parliamentarian, "Thank You for your service but it's no longer needed" because they're either not listening to her or she's giving them bad information!

    Rescind mystery solved?
    From Minutes of the November 17, 2022 Board Meeting:
    Unfinished Business:
    1. Motion to Rescind – Vice President Ege – I move to rescind the recommendation of the Finance and Budget Committee to approve the 2023 Budget except for the recommendation to transfer $4.5 Million from carry forward to the Capital Reserve. The 2023 Budget includes the increase of the annual property assessment to $525. The motion was seconded by Secretary Lenefsky.

    Parliamentarian Chornenky explained the motion was to rescind because it would wipe out the failed motion from the previous meeting and we would be able to vote on the motion again.

    Director Collins moved to postpone this vote till the December 15, 2022 meeting so the Board could understand what the motion was, seconded by Director McAdam.

    Prior to vote, Secretary Lenefsky asked General Manager Cook what would happen if we did not pass the budget and the answer was we would have no authority to spend money or pay wages. Secretary Lenefsky also noted that the Finance and Budget Committee unanimously approved this budget to be recommended to the Board for vote.

    President Lehrer also added that this was a committee recommendation which passed unanimously.

    Vote was taken and the motion to postpone passes 7 to 2 with Director Wilson and Secretary Lenefsky opposed.

    Someone needs to tell Parliamentary Chornenky to go read Robert's Rules 6:27 Note 4: "...the motion to Rescind or to Amend Something Previously Adopted can be applied only to a motion on which the vote was affirmative..."

    Director Ege's motion FAILED!!!!!! There's nothing to Rescind! This ain't rocket science folks, it's simply understanding what the words mean!!!!

    And if they would only admit that each meeting is an individual session, which it really is, then they could simply offer the same damn motion again at the next meeting and every future meeting until it either passes or or the presenter gets tired of offering it! They're drowning themselves in their own made-up rules!

    Now we know the 12.15.22 agenda should have NO Motion to Rescind on it! How do we close the door on this rescind debacle?

    It should NOT have been allowed to begin with, as Tom has explained.

    Therefore, Steve’s motion to postpone the Vote to Rescind should not have been allowed because it did not really exist.

    Anyone else slightly dizzy?

    Steve's motion was a good motion.

    I believe Steve's motion to postpone was because the board, as well as the parliamentarian, was confused! Remember, the original motion was suppose to be to Reconsider, but they finally realized that they couldn't use that motion so they tried to switch it to Rescind! But, then again, some Board members argued that they couldn't Rescind the motion either so with all the confusion they postponed the issue until they could figure out what the proper motion would or should be!!!!

    This is what happens when nobody understands proper parliamentary procedure or the rules that they are "suppose" to be guided by!

    Like I said above, it's as clear as it could be that you can't Rescind a motion that failed....end of story! But apparently somebody is reinventing the definitions or what a rule actually says.

    It's down right discussing!
