I dunno, but sure Bill will enlighten us. I was hoping Cook would start his reign by having some sort of open Town Hall Let's Chat--what's working, what's not type of mtg. but I fear he's following the same ruts laid down....

Let me start out by saying, i didn't write it...i will freely admit to having read it. It being the recall petition my neighbor filed today. It was well done, respectful and to the point: Recalling Sue Wilson for having lost the support of the membership for the actions over the past several months. It wouldn't have been what i would have written, but in honesty, i wouldn't have had the energy or interest in going through the motions to get it started.

I told you last week a guy knocked on my door and wanted to chat. We talked for about a half hour. I knew him to say hi in passing, but didn't even know his first name. By the time we parted i knew both first and last name and had enormous respect for him. He was angry by the way we were treated when we showed up for the Sept 13 board meeting. It was enough to push him over the edge, to file the petition and then work his ass off to get enough signatures. I was impressed.

I saw the copy he wrote this morning, suggested a few tweaks and saw what he was going to submit. Looked good based on what i read from the by-laws. Apparently he dropped it off at Lakeview today. He told me the new GM called him later and told him he couldn't accept it. I asked incredulously, why not. He said Bill told him he didn't cite the by-laws Sue broke to qualify for a petition to be filed. I almost shit myself.

Two problems with the new GM's position. First, it's not his job to reject it and second there's not a freaking word in the Articles of Incorporation or the By-Laws about having to prove/show a violation. Let's be blunt, the language is just one big circle jerk to start with. Lots of mumbo jumbo and hoops to jump through that are nothing more than to discourage members from even trying.

I guess that's not bad enough. Now we know, they are just going to make crap up as they go and hope we are dumb enough to eat the crap sandwich they serve us. You may not like the petition Mr. Cook, but it is not your job to deny it or make up rules that don't exist to keep it from hitting the table.

I can tell you what bylaws she broke. I won't go into the details here but will simply say she and many others on the board know that the board is purposely not complying with either their own bylaws or Robert's Rules which is a dereliction of their duty and violation of their oath of office. For that reason alone director Wilson should be written-up or forced to resign.

I've already tried to show Bill Cook what rules Sue has broken but he simply ignored me.

Just like Cook made up the rule while we were standing there with signs.... it's on video on the Facebook page.. someone says, what rule? And he says, " I just made it up". Great another decade of a GM with their own agenda. This crap has got to stop. Who hires these people? Did the board hire him or did Eck hire him to replace her? Like someone said earlier, if Eck is kept on as a consultant, then the wrong GM was hired. We need legal advice, there has got to be retired lawyers in SC that can offer advice.

Can the petition be amended with the broken bylaws cited?

They don't need to be, there is no rule regarding it. I told my neighbor if they haven't accepted it come Thursday it will be the cornerstone of my discussions at the mic. Think about the insanity: They fired Karen for manufactured and mangled rules and then they keep shoving manufactured and mangled rules at us. What the flock is wrong with that picture?

Perhaps Bill Cook should read the bylaws as well?

ARTICLE IX – INITIATIVE, REFERENDUM AND RECALL PETITIONS

SECTION 1: STEPS TO TAKE BEFORE CIRCULATING A PETITION
    1. Consider alternatives before beginning the petition process:
      1. Bring the issue to the attention of the Board at Board meetings or in other direct communication with the Board.
      2. The Board will consider the issue and provide in writing their consensus regarding such. If the Board approves, action will be taken accordingly. If the Board disapproves, proponents may initiate the petition process.

We've got to quit telling them what their documents say FYI. They apparently like it better when they can just make crap up and spew it across the land.

Like I said earlier, the ignorance of their own bylaws makes them unworthy to serve!

Mike is one very smart guy. It appears the number of really qualified people is growing in number and interest. Very cool to watch as this mushrooms and spreads.

I revised my original letter to the editor, about 10 minutes after I submitted it. The agenda for Thursday's meeting popped up in my email within a minute of my original submission. So I made a correction. This is a first reading and not third reading (I misread the Agenda for the prematurely adjourned meeting on 9/13). Same issue.
Importance here is they may decide to bypass 2nd and 3rd readings. I looked for my letter in the printed edition today and didn't see it. I did not look for it online. It would have been nicer if it hit the printed edition. Circulation for the printed edition is 23,700 (per circulation dept; 3/11/21). That would be far greater exposure than Talk of Sun City. But hey... I'm in the paper ;)

I would think that if we got 4,000 signatures (even if not accepted as valid by RCSC), it could be a blip on the Phoenix Media (Radio, TV, Newspaper (AZ Republic)). We might even get one of those TV "On Your Side" reporters to inquire. Worth a try?

Some of those very contacts to news organizations have been bantered about Mike and as this grows they will be expanded. I know folks are chomping at the bit to turn this into a circus, i'm not of that mind yet. We need to get in front of the board and start pinning them down. Their actions, which they appear to believe are perfectly normal, are anything but. As i said last night to a friend, we need to grow the circle, we tend to talk in an echo chamber.

In another discussion with the neighbor who dropped off the recall request he said the new gm was worried about Sue's due process rights if this proceeded forward. Are you freaking kidding me? A board of 7 kicked Karen off the board in a half hour hastily called meeting; as McAdam pointed out yesterday in the paper, there was NO due process. In Sue's case, we need to grovel to get the recall started, sign 3650 signatures, all off rcsc property, and then convince half the community to vote to kick her off. Not to mention the entire time they can pander to the crowd with their in-house communication network.

Let that sink in for a few minutes. Due process indeed.

Is there a document somewhere that defines the GM's responsibilities?

How did the GM get to see the recall notice?

In my mind, the GM has no say in the wording of any RCSC document.
The GM should not be telling anyone they can't file a recall notice because they didn't cite a by law that Sue broke.
The GM should not be calling anyone unless the individual he is calling has asked him to call.
The incoming GM is a student of the outgoing GM.

More and more bylaw changes will be forth-coming as a result of what is being said and proposed on this forum and on Facebook.

The BOD and GM are monitoring this forum and Facebook for clues on what the general population is proposing so they can mount a defense
and make appropriate bylaw changes to further restrict member involvement.

As for any petition process on RCSC properties, did any ever hear of DocuSign? Pettition and signatures can be gathered ONLINE.
Whoops!!!! Shouldn't have said that. There will probably now be a bylaw change prohibiting that.

Bill, I know you are not interested in a lawsuit, but how about detailing what the board has done and is doing and asking the Attorney General for
    an investigation.
Whoops!!!! Did it again. BOD/GM will see this and start mounting a defense using political connections and bylaw changes.

Damn SCR, that is brilliant. I have used DocuSign and it is a fascinating suggestion. Just so you know the by-laws already state that a circulator must witness the signature. I would want to get a clarification before we go down that road. Better yet, i see a hundred or more house parties where members of the community gather and sign the recall petition. The rules governing this process are pure unadulterated bullshit, poorly written and intended to care folks off the process. I need to get my hands on the old by-laws and see when this tripe was written.

Yes, yes a thousand times yes to your comments regarding the new gm. None of that was his job. The rules are specific regarding the recall application and nowhere in them is the gm mentioned. Duh.
