Don't know what your point was to raise the Preamble? Actually, the Preamble provides nothing more than to set the tone of the Constitution. Unlike the Constitution, which is the law of the land, the Preamble is not law and conveys no powers to the government. Tom, have you actually read the Federalist Papers or just Google stuff? Try reading case law sometime, the actual cases not summaries. Why do we have Constitutional law class in law school, why do we have attorneys specialize in Constitutional law, why has Constitutional law evolved over the years or in Clarence “Slappy” Thomas’ case, regressed?
I have read them, as well as the Anti-Fedetalist Papers several times, and if you would read them you would find that there are many things being done that our Founders warned against such as making laws that only apply to the people but not on themselves. Federalist 57: "If this spirit shall ever be so far debased as to tolerate a law not obligatory on the legislature, as well as on the people, the people will be prepared to tolerate any thing but liberty." And this is why we are losing our Country!
