Lawsuit Update - After Members Meeting

    It's always curious to see a non-lawyer give a lawyer advice on how to be a lawyer.

    Kinda reminds me of the saying, "a man who represents himself has a fool for a client."

    Along those same lines, a lawyer who takes the advice from a non-lawyer.....

    He said at the member meeting that he was a lawyer. You can only say you are a lawyer if you are admitted to the bar and you law license is up to date. Saying that you were admitted to appellate court and something else (sorry I forgot what it was) in 1981 (I think) might not make you a lawyer now. The chair of the by laws committee was an attorney in CA for 40 years but is not an attorney in AZ as he chose not to take the bar exam.
    Bottom line, I do not like portraying themselves as something they are not. In some instances it can be dangerous. His failure to respond tells me a lot.

    I am attorney-in-fact for my neighbor, who is old and lost his partner a year ago. We had to put his dog down this morning.

    You have a power of attorney (POA) probably over estate and person. That is different from attorney-in-fact as I was formerly one during my career.

    I never represented myself as an attorney. I did say that I worked closely with attorneys while in VISTA and during my underwriting career. When I had appear in court via emergency motions, the first thing I advised the judge about that I was not an attorney and our inside and outside counsel advised to ask for continuance In the matter. I also appeared in my official capacity as an underwriter and liked insurance agent both in State and Federal with no problems in either instance. I said this many time before but you and that clown Josie choose to ignore.

    Actually this shows me that the mental intelligence of the MAGA crowd in addition to being a gathering of snowflakes, is 500 points lower than T Rex and how did things work out for them?

    I think Mr. Fast lives in Colorado. Perhaps he has taken the bar exam there and is licensed as a lawyer in that state. It doesn't matter to me. I believe he is a lawyer. Or he could be retired and decided to not renew his license. Why would you accuse him about portraying something he is not unless you have definitive proof? As someone who is not lawyer, I would think that would be a given.

    You, knower of all things, should understand that a will is a private and very personal document. I have no clue who or what makes you believe people have to prove things to you. I owe you nothing. You deserve nothing from me. I don't have to prove anything to you, and for the record why do you even care?

    He said he was and I have no reason to doubt him. A person who lies regularly may doubt things others say and demand proof. Just a guess tho.

    That was a giant leap, Dave! To discussing whether one of our readers has a law license to suggesting the mental intelligence of the MAGA crowd being 500 points below that of a T Rex.

    Tell us your IQ please. Remember it's not a set number; rather it is reported as being within a range. I was involved in scores of meetings, probably hundreds, where educational psychologists presented intelligence testing results to parents and staff. Those were compared to the language test scores that I had administered and the academic testing scores given by other staff to see if there was a specific learning disability or some other type of disability such as an intellectual disability (mild, moderate, or profound), autism, developmental delay, multiple disability, emotional disturbance, other health impaired, or one of the other 13 disability categories.

    The IQ scale doesn't even go to 500 so your comment is absurd. Now you are showing which range you are in - 85 to 115 is considered average. Btw, IQ scores can change and the assessments used aren't perfect. We usually wanted two to three reported scores, with the tests given at least two years apart, before considering them accurate.

    You are not the only one with considerable experience. Yes, after working in a career with adults and children, I can usually pinpoint which IQ range a person is in after interacting with them over a period of time.

    Please keep the political crap in the crappy political thread where it belongs Dave. Demeaning and insulting members of our community and on this site is simply tacky and juvenile. Nothing wrong with having discussions regarding differing opinions, but the constant assault of personalities, their values and how little respect you have for them is becoming intolerable.

    Not only myself but others have researched the list of admitted lawyers in CO and he is not there, same for Ohio. The problem Janet is that since he is not admitted in AZ, CO OH, is cannot give legal advice nor represent clients in court. Simply put, I am on the same level as him but he has a JD which entitles to take the bar in any State. That is why I inquired if he was doing his action pro se, which he did. Aside from that statement about his admission about the early 80s, he has been silent about renewal.
    When someone says they are filing a lawsuit, I want to be sure of the qualifications of the person potentially representing me. There are other sources to research such as Martindale Hubbell. Bet you didn’t know that Tom.

    Hello Dave,

    Once again you go off on tangents. While you do not deserve a proper response, I will give you one. As you know, the lawsuit was filed pro se because my timely made motions were not allowed to be discussed or voted upon at the annual meeting. The bedrock issue is whether I have the right to have my motions heard and voted upon. I could care less about your demeaning insinuations and would never represent you in any matter. As I said, i think you are walking on very thin ice and encourage you to let it be.

    You can’t represent me in court, as for administrative hearings I have a legal beagle for that plus I have done many of those so I know the process. One reason I wanted anyone brought before a Board hearing to have representation and discovery. Current policy unfair and I tried to change while on the by laws committee.

    If I recall correctly, I supported you on that policy change, Dave. I also wanted the Member(s) to be able to request the hearing(s) be held openly if that is what they desired. That would prevent a kangaroo court setting. Of course, the Member could also choose to keep the hearing in a closed setting. Neither one of us prevailed, largely because the rewrite of the bylaws was predetermined by others not sitting at our table.
