Bylaw Rewrite...Objectively Speaking...

    Why is the board hijacking OUR precious Member Exchange time allowing GM Cook to present ANOTHER State of the Union at the Monday, November 7, 2022 Exchange??? It’s at 9am, Sundial auditorium.

    Isn’t that an annual, as in ONCE a year, address and not monthly??

    Wouldn’t consider communicating that big of an announcement at the Annual Membership meeting last Tuesday…too transparent?

    I see on the Sun City Advocate's blog, Dave is back, this time explaining his ringing of the bell repeatedly as Joe was trying to ask very real questions about a very real issue. As i read his attempted rebuttal, it was pretty garbled. Joe, being the gentleman he is, was kind in his response. In fact, way kinder than me...nothing new there.

    I was stunned to read what he tried to type because it appeared he didn't even know what sections or article numbers Joe was talking about. That on it's face was disturbing, in that Dave just spent "hundreds of hours" creating this perfect document (said cynically). That aside, bylaws are confusing and it does help to state exactly what the sections are that are in dispute. I took the time late last night to type in the language both Joe and i saw as problematic, so perhaps he will be better able to hone in on the specific verbiage that made no sense.

    Rather than blathering on, here is a cut and paste to help each of you understand the argument:
    ARTICLE IX – RCSC INITIATIVE, REFERENDUM AND RECALL PETITIONS SECTION 1: APPLICATION FOR RCSC PETITION FORM
    A. Check box for the petition you are seeking, Initiative, Referendum or Recall, state reason and signature of Petitioner. (Need to have exact language on petition.)
    B. The completed application for petition will be filed with the Secretary of the Corporation.
    C. Control number is given (pro forma) by RCSC Corporate office along with the petition start and end date (120 days).
    D. A referendum or recall petition must set forth the existing policy, rule or bylaw that is being challenged in clear language that will allow the challenge to be determined by a “YES” OR “NO” vote. Any proposition will be subject to the requirements and limitations of the Corporate Documents.
    E. Recall petitions for a Director or Directors shall not be issued by RCSC if the petition is based upon any unlawful or discriminatory basis, including, but not limited to, race, color, religion, national origin, sex, sexual orientation, age, physical or mental disability or veteran status.

    Everything is pretty straight forward until you get to the letter D. This isn't rocket science, it says (in bold again), "D. A referendum or recall petition must set forth the existing policy, rule or bylaw that is being challenged in clear language that will allow the challenge to be determined by a “YES” OR “NO” vote." That is 100% absolutely clear to me and Joe, must set forth the existing policy, rule or bylaw that is being challenged.

    Every time Allan tried to rebut Joe, he cited section E. That's not the issue or the question. Last year a member applied for a recall petition 4 times, each request was denied. He never cited a policy, rule or bylaw. He did however present logical reasons for the recall; they were denied every time. Joe specifically asked why this new language would be any different, he was never answered other than to tell us the new language is better. It's not, in fact, it's worse.

    Hope that helps folks sort this out. My continuing efforts are to make you all a little wiser.

    I'm trying to figure out where they get their power, or how they feel they are entitled to that type of power. I'm sure it's covered by some type of kangaroo due process hearing procedure to make sure they're covered. It's baffling.

    It's pretty simple Linda, we've seen it in play: Retreat to an "executive session," and nothing can ever be said. Who knows what happens or even why? They are protected and insulated by the mandated silence they have cloaked themselves in. Barbara Brehm was fired and she drafted a lawsuit (yes, she had some legal training). I have a copy of it and partially her focus was something we have talked about away from the maddening crowd; how the RCSC is structured under the IRS tax codes. It's an area the RCSC should be terrified of.

    Once Barbara moved out of Sun City their ability to threaten her with expulsion of her member rights were dead in the water. She was free to say whatever she wanted and we have spoken several times and she has provided me with much of her documentation. Like Karen, she was smarter than many of her fellow board members and it's pretty clear how intimidating that is to those who are in over their heads.

    Kind of explains everything doesn't it?
